3. How to Submit a DMCA Takedown Notice

4. What Happens After You Submit a Notice

Our DMCA Process:

1. Receipt Confirmation (Within 24 hours):
   • We will acknowledge receipt of your DMCA notice via email
2. Review (24-48 hours):
   • We will review your notice to ensure it meets DMCA requirements
   • If information is missing or unclear, we will contact you for clarification
3. Action (Upon Validation):

5. DMCA Counter-Notification

If you believe that content you uploaded to Manhwajoy was removed due to a mistake or misidentification, you may file a DMCA counter-notification under 17 U.S.C. § 512(g)(3).

Requirements for a Valid Counter-Notice

Your counter-notification must include:

1. Your contact information:
   • Full legal name, mailing address, telephone number, and email
2. Identification of the removed material:
   • The specific URL where the content appeared before removal
   • Description of the content that was removed
3. Good faith statement:
   • “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”
4. Consent to jurisdiction:
   • “I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or [Your Jurisdiction] if outside the United States), and I will accept service of process from the person who provided the original DMCA notification or an agent of such person.”

6. Repeat Infringer Policy

Manhwajoy has adopted a policy of terminating access for users who are repeat copyright infringers, in accordance with DMCA requirements.

Users or uploaders who receive multiple valid DMCA takedown notices may have their content removed and access to the platform restricted or permanently terminated.

7. False Claims and Misrepresentation

Warning: Filing a false or fraudulent DMCA notice is a violation of federal law and may result in:

• Civil liability for damages, including costs and attorney fees (17 U.S.C. § 512(f))
• Criminal prosecution for perjury
• Dismissal of your claim by Manhwajoy

Please ensure that you are the legitimate copyright holder or authorized representative before submitting a DMCA notice.

Similarly, filing a false counter-notification carries the same legal risks. Only submit a counter-notice if you genuinely believe the content was removed by mistake or misidentification.

8. What is NOT Covered by DMCA

The DMCA process is ONLY for copyright infringement claims. We cannot process DMCA notices for:
